The term used for violence which takes place in family situations and particularly between couples, whether married or unmarried. A victim of domestic violence can obtain court orders against the abuser under the Family Law Act 1996 .
These civil orders are in addition to any criminal prosecution the police may bring for assault:
• Non-molestation order : an order to stop serious pestering or harassment;
• Occupation order : an order that the abuser does not enter the victim’s home even if it is his home as well. This has replaced the ouster order (or injunction)
The court has the power to send to prison a person who breaches either of these orders.
